Welcome to the Order Form for ClassMobile Manager.
Upon completion of your order, you will be supplied with the URL to your ClassMobile Manager and steps for the final configuration of your Links database.
Links Recomments that your ClassMobile site can be themed to be consistent with your website. This will allow you to have consistency of your brand from your website through to ClassMobile so it doesn’t appear as obvious to your customers that they have left your website to use another application.
Please note you can do this yourself through the Active Carrot Manager login, for which you will receive details when you receive your order confirmation.
*If you do not have a Website developer that can do this for you, then we can arrange for this to be completed for you for a cost of $500 + GST (this will be debited with your first payment). Alternatively you can have a basic design that includes colour selection and logo’s free of charge.
(a) LMS and Client acknowledge that they entered into a Software License Agreement (“the License Agreement”).
(b) LMS and Client hereby agree that they wish to vary the terms of the License Agreement as set out in this Variation Agreement.
THE PARTIES AGREE
(1) Variation of License Agreement
The Parties agree to vary the terms of the License Agreement as follows:
Addition of the ClassMobile Manager online module
All payments must be made in accordance with the terms of the License Agreement. I understand that payments shall be deducted as per the Direct Debit Request on the 1st business day of each month.
(2) Term and Termination
The variations contained in this Agreement shall take effect on immediately upon the receipt of this online form and shall remain in place until termination of this Agreement, or termination of the License Agreement.
The Parties agree that this Agreement may be terminated in accordance with the termination clause outlined under the License Agreement.
The Parties agree that this Agreement shall immediately terminate upon termination of the License Agreement for any reason.
(3) Governing Law and Dispute Resolution
The Parties agree that the governing law shall be the governing law outlined under the License Agreement. In the event of a dispute, the Parties must submit to the mandatory dispute resolution process outlined under the License Agreement.
(4) License Agreement
The Parties agree this Agreement shall be read subject to and in conjunction with the License Agreement, and shall vary the License Agreement only to the extent outlined under clause 1 above. The Parties agree that the License Agreement shall remain in full force and effect, and nothing in this Agreement shall relieve Client from any responsibilities or obligations contained under the License Agreement. Any additional software and/or services provided by LMS under this Agreement shall be subject to the terms and conditions of the License Agreement.
